Koror, Palau: In a decisive victory, a Palau court has ruled in favor of the 2017 Will of Yutaka M. Gibbons, paving the way for his wife, Maricar Paulino Gibbons, and their three minor children to inherit the entirety of his estate. The February 19th, 2024, decision concludes a legal battle that erupted after Mr. Gibbons’ passing in December 2021.
Challenges to Will Dismissed:
Competing claims arose, contesting the legitimacy of the 2017 Will and pushing for the recognition of an earlier document from 1998. However, Judge Materne reviewed the evidence, including witness testimonies and audio recordings, ultimately finding the 2017 Will met all legal requirements. The court confirmed Mr. Gibbons possessed sound mental capacity at the time of signing and dismissed allegations of undue influence.
Witness Credibility Upheld, Earlier Will Nullified:
The 2017 Will’s witnesses, Belen Pipit and Viola Dilbuil Kanai, were deemed competent and disinterested, satisfying legal requirements for proper witnessing. Consequently, the 1998 Will was invalidated due to its conflicting dispositions.
Estate Distribution and Prior Claim:
Following the court’s determination, Mr. Gibbons’ estate will be distributed as outlined in the 2017 Will. His real properties and remaining assets will be divided equally among his wife and children. However, this distribution is subject to a prior claim of $925,000 awarded to Ngerkebesang Hamlet in a separate court case (Civil Action No. 21-144).
