Ex-WIOA (Workforce Innovation and Opportunity Act) Kei’Ile Mikel agreed to a plea agreement, pleading guilty to Theft of Government Property in the First Degree (Class B felony) and Violation of the Code of Ethics(misdemeanor offense).
In pleading guilty to the two counts, the defendant is ordered to serve 18 months imprisonment, but all are suspended except for the jail term, which is capped at no more than 60 days.
In addition, the defendant will pay a fine of $3,000 ($2,000 for Count 1 and $1,000 for Count 2).
Also, as a condition of the agreement, Mr. Mikel will pay restitution to WIOA, Republic of Palau, which could go up to $46,493. This amount is still to be determined by the Office of the Special Prosecutor.
By pleading to Class B felony as part of the negotiated agreement, Mr. Mikel agreed to pay whatever final amount is determined for restitution, even if it exceeds $20,000. He will be given a monthly payment plan that requires a payoff at least one month before the probationary sentence expires.
The defendant will be placed on probation for 10 years, and after serving half of that, the probation may be terminated.
The sentence and conditions imposed will not take effect until Defendant Mikel testifies in the following criminal cases, ROP v Nglodech Luii, ROP v Carmine Dermody, and ROP v Josephine Ulechong. (
