Caroline Baird: Former AAG, disbarred from practicing law in Palau.

Private attorney Caroline Baird of Carolines Law Firm has been disbarred from practicing law in Palau, effective March 3, 2022, according to the notice of disbarment from the Palau Supreme Court.

Mrs. Baird, also a former Assistant Attorney General, was disbarred by the appointed Disciplinary Tribunal after she failed to comply with sanctions imposed on her due to violations of both the Republic of Palau’s Disciplinary Rules and the American Bar Association Model Rules of Professional Conduct.

In 2020, a disciplinary complaint was filed against Mrs. Baird, alleging “misrepresenting and /or concealing a material fact in her application for admission to the bar” in violation of ROP disciplinary Rules and ABA Model Rules of Professional Conduct. It also alleged Baird made misleading or false statements regarding her education, experience, and expertise; additionally, she failed to “act with reasonable diligence and promptness in representing a client”, as well as failed to “uphold the duty of honesty and candor with the court during her representation of Mr. Ngirameketii” in a Civil Case Appeal.

After the investigation and prosecution, it was determined that Mrs. Baird submitted incomplete information for admission to the bar, published misleading advertising on her website, and failed to “actively and diligently process her client appeal”–all in violation of Palau’s Disciplinary Rules and ABA Model Rules.

The Disciplinary Tribunal imposed “Privately Censured” as a sanction against Baird for the violations. In addition to being censured, Baird was mandated to complete 10 hours of CLE courses on “practice management, attorney advertisement, communication with clients and obligations of counsel in withdrawing representation”, as well as pay the cost of investigating and prosecuting the cases by December 31, 2021.

The notice of disbarment cited that Mrs. Baird failed to comply with sanctions imposed by the Disciplinary Tribunal after she violated the ROP’s Disciplinary Rules and the AMA Model Rules of Professional Conduct.
