Rights affecting lesbian, gay, bisexual, transgender, and queer (LGBTQ)  are missing in the Palauan law, according to the latest Legal Gap Analysis of Gender Equality  Report by Palau and the International Migration Organization ( IMO).

The report recommended an introduction of legal procession against sexual orientation or gender identity “ in all areas of life, including employment.”

The report also recommends registration of same-sex marriage overseas to allow access by surviving spouses of insurance.

Under the Palauan constitution, only marriage between a man and a woman is recognized. The LGBTQ community in Palau supports the removal of the constitutional provision against same-sex marriage.

The report also noted that the government should consider putting in place processes to allow transgender to change their gender identity documentation.

The Vice President and Justice Minister presented the report to the members of Olbiil Era Keluau The report only contains legal gap recommendations on gender-based violence, children’s rights, and the rights of people with disabilities.

VP Senior said the report can serve as a “valuable resource for informed-decision making  and policy formulation.”

In 2014, Palau decriminalized same-sex sexual relations.
